Definitions

These Terms of Sale govern all transactions carried out by the French Individual Company Marine Collery, hereinafter referred to as “the Seller” or “Atelier Castin”, with non-professional customers, hereinafter referred to as “the Customer”. By placing an order with the Vendor, the Customer acknowledges and fully accepts these terms and conditions.

Products

The Products covered by the terms are those which appear on the Site and which are sold directly by Atelier Castin.

The characteristics of the Products are described on the corresponding page of the Site. It is the Customer's responsibility to take them into consideration before any purchase. The diagrams and photographs presented on the Site are not contractual.

Patterns are available for purchase as downloadable PDF files. Once payment has been received, the PDF file(s) can be downloaded directly from the order confirmation page. In addition, an e-mail containing an indefinitely valid download link is sent to the customer once the order has been confirmed.

Please note that PDF pattern orders are non-refundable and non-exchangeable. As these items are dematerialized, they cannot be returned.

Intellectual Property: The Products offered by the Seller are protected by copyright. Any unauthorized reproduction, distribution or use of the patterns is strictly prohibited.

Prices

Pattern prices are given in euros (or in the local currency if supported by the online store), all taxes included. To support payment in local currency, prices are automatically converted according to the exchange rate in force on the market, which may lead to fluctuations over time. The Seller reserves the right to modify its prices at any time, while guaranteeing the Customer the price in force at the time of ordering.

Order and Payment

Customers may place orders via the Vendor's website. Once payment has been received, all orders are considered final and irrevocable.

The following payment methods are supported: Visa, Mastercard, American Express, PayPal, Shop and credit card.

Withdrawal

In accordance with the provisions of article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to digital products offered on the Site. The right of withdrawal therefore does not apply to all purchases possible on the Site. Once the digital content has been purchased and/or downloaded, it is considered as used and cannot be returned, exchanged or refunded.

Legal warranty

Products sold on the Site are guaranteed in accordance with the legal provisions of the French Consumer Code (garantie légale de conformité des biens - articles L. 217-3 to L. 217-32 du Code de la consommation). In accordance with the legal guarantee of conformity for goods comprising digital elements and supplied on a one-off basis, defects in conformity are presumed to exist for 2 years from delivery of the goods.

According to article L. 217-5, a product is considered to be in conformity when it corresponds to the description, type, quality and quantity specified in the contract, when it is suitable for the particular use intended by the consumer, and when it is delivered with the instructions agreed in the contract. In addition, the product must benefit from any updates provided for in the contract.

In addition, conformity is assessed on the basis of the use usually expected of a product, taking into account its characteristics as specified in the contract.

Dispute settlement procedures

The Terms and Conditions of Sale/Use are governed by French law. In the event of a dispute between the Customer and the Vendor during the performance of the present terms and conditions, an attempt will be made to resolve the dispute amicably. If this fails, the disputes will be submitted to the competent courts of common law.

For customers from the European Union: An Online Dispute Resolution (ODR) platform is provided by the European Union. It serves as a one-stop shop for resolving disputes between EU consumers and merchants concerning national or intra-European purchases. The system aims to promote amicable dispute resolution by referring disputes to affiliated national out-of-court dispute settlement bodies.

Modification of the Terms of Sale

The Vendor reserves the right to modify these Terms and Conditions of Sale at any time. The Sales Conditions applicable are those in force at the time of the order.
